Terms & Conditions

Definitions

  • Charterer: The person or entity named on the Proforma Invoice/Tax Invoice.
  • Owner: Opal Yacht Rental Dubai and/or associated third parties.

Agreement to Charter

The Owner agrees to let the vessel to the Charterer, and the Charterer agrees to hire the vessel under the following conditions:

  • Payment Terms:
    • 50% deposit to confirm the booking
    • Remaining 50% balance upon arrival
    • 100% prepayment for additional services
  • Minimum Age:
    Individuals under 18 are not allowed to register or transact via our website.
  • Trip Time Calculation:
    Trip time starts from the guest booking time or boarding time (whichever is earlier) until the last guest departs.

Yacht Use & Access

  • Access is limited to public areas only.
  • Control rooms, equipment rooms, and crew areas are strictly prohibited for guests.

Decorations & Catering

  • Decorations are allowed but must not damage the yacht. No staples, nails, glues, or strong adhesives.
  • Caterers hired by the Charterer must clean and maintain the galley.
  • Selling products or services onboard is prohibited.

Yacht Categories

  • Eclipse Sovereign: Imperial Class
  • Celestial Majesty: First Class
  • Voyager Elite: Executive Class
  • Explorer Goldeon: Economy Class

Images/specs are indicative only for certain categories.

Redelivery & Condition

The Charterer must return the yacht in good condition, free from any debts, and in the same state as at delivery (except normal wear).

Cruising Area

  • Cruising is limited to pre-approved areas within legal boundaries.
  • The Captain’s decisions on safety, routes, and berthing are final.

Guest Limits & Children

  • The maximum guest capacity must not be exceeded.
  • Children are under the full responsibility of the Charterer.
  • All children under 10 years must wear life jackets at all times while on deck or in water.

Captain’s Authority

  • The Captain has final authority regarding safety, routes, weather conditions, and guest conduct.
  • Misconduct may result in termination of the charter without refund.

Operating Costs

  • Standard trips include fuel within Dubai waters.
  • Extra costs apply for extended routes or special services.
  • Advance Provisioning Allowance (APA) may be required for custom expenses.

Delays & Force Majeure

  • Delays due to Force Majeure (weather, government orders, etc.) may lead to rescheduling or refund based on conditions.

Cancellation & Refunds

  • No refunds for guest cancellations.
  • Rescheduling may be possible upon request.
  • If Opal Yacht Rental Dubai cancels due to safety issues, a full refund or reschedule is offered.

Conduct & Legal Compliance

  • Guests must comply with UAE laws, including no drugs, no weapons, no offensive behavior, and no illegal activities.
  • No smoking is allowed inside the yacht.
  • Pets are not allowed on board.
  • Obscene acts, loud music in restricted areas, and reckless behavior are prohibited.

Safety & Identification

  • All guests must present a valid Emirates ID or Passport before boarding.
  • Life jackets must be worn when required by law or at the Captain’s discretion.

Damage & Liabilities

  • Damages caused by guests will be charged based on actual repair costs.
  • A minimum AED 2,500 will be charged for accidents.
  • For downtime of the yacht due to guest-caused damage, AED 500/day may be charged.

Insurance

  • The yacht is fully insured.
  • Charterer is responsible for personal belongings insurance and medical insurance.
  • Losses due to Charterer’s negligence are not covered by Owner’s insurance.

Indemnity & Waiver

  • By signing, the Charterer agrees to indemnify Opal Yacht Rental Dubai for any third-party claims, damages, or legal fees, unless due to the Owner’s negligence.

Weather Policy

  • Sailing will not proceed in unsafe weather conditions.
  • The Captain’s decision is final.
  • In such cases, the Charterer may choose to reschedule or cancel with a full refund.

Fines & Coast Guard Regulations

  • All UAE marine laws must be followed.
  • Any fines due to Charterer’s behavior or non-compliance will be charged to the Charterer.

Music & Alcohol

  • Loud music is not allowed in Dubai Marina or Lagoon.
  • Alcohol consumption must comply with UAE liquor laws.
  • No swimming while the yacht engines are on.

Children & Safety

  • Children under 1 year old are only allowed on yachts 40 ft and above.
  • No open flames or shisha are allowed onboard.
  • Candles for cakes are permitted with crew supervision.

Third-Party Liability

  • The Charterer is responsible for injuries or damages to third parties unless caused by Owner negligence.

Arbitration & Law

  • All disputes will be resolved under UAE law through EMAC arbitration in DIFC, Dubai.
  • Either party may seek legal action to secure claims.

Contact & Notices

  • Notices must be sent by email, courier, or written letter to the addresses provided at booking.

Acknowledgment

By confirming the booking, the Charterer acknowledges having read, understood, and agreed to these Terms & Conditions.
